    U.S. citizens haven’t always had the guaranteed constitutional right to an attorney. This month marks the 50th anniversary of the landmark Supreme Court case, Gideon v. Wainright.

    The case involved a man by the name of Clarence Earl Gideon, charged with burglary, who was subsequently denied counsel by Florida courts. Once convicted and imprisoned, Gideon used his time in incarceration to do research in the prison library. Eventually, he had built up enough of a case to bring forth an appeal to the U.S. Supreme Court, charging against the Florida Department of Corrections that he was not granted his right to an attorney, and that his Sixth Amendment rights had been violated.

    On March 18, Supreme Court Justice Hugo Black issued the following decision in Mr. Gideon’s favor:

    “It is an obvious truth that a fair trial for a poor defendant could not be guaranteed without the assistance of counsel. Lawyers in criminal courts are necessities, not luxuries.” – Gideon v. Wainwright – 372 U.S. 335 (1963)
