    Governor Brown has been keeping a strict stance against changing criminal law in California, much to the chagrin of those seeking to ease prison overcrowding by lowering inmate sentences.

    As the gatekeeper of new laws in California, Gov. Jerry Brown has steered a mostly liberal course this year, signing legislation that expanded the rights of undocumented immigrants, increased access to abortion and granted overtime pay to domestic workers.

    On crime and punishment, it’s a somewhat different story.

    In a standoff with federal courts on overcrowding and health care in state prisons, the Democratic governor has resisted proposals to lower the prison population by reducing the sentences of any of California’s 120,000 inmates. Brown notes that his “realignment” program has already sent 24,000 low-level felons to county jail instead of prison, and says the remaining inmates are too dangerous to release.

    He took a similar position when legislators approved SB649 by state Sen. Mark Leno, D-San Francisco, which would allow, but not require, prosecutors to charge possession of heroin or cocaine as a misdemeanor rather than a felony punishable by up to three years in prison.
